Donut Gate! School Board Candidates Melinda Lemke and Jonathan Curtis Bringing Gifts To Teachers May Violate Wisconsin Law and School Board Policy.

A Wrightstown teacher recently took to Facebook to thank Melinda Lemke and Jonathan Curtis who are currently running for the district’s school board.

“I just wanted to extend a very sincere THANK YOU to Jonathan Curtis, and Melinda Menting Lemke! They brought donuts and muffins for the staff at the middle school today, and had all sorts of fun stickers and pins to go with it.”

The Facebook post goes on to read, “To say we appreciate your kindness would be an understatement. Little acts of kindness like this go a long way, and made our days a little brighter. Thank you both, as well as everyone else who is fighting for this recall around the clock.”

The post includes a photo showing a note that appears to be from Lemke and Curtis expressing appreciation to the teachers. It is signed with their campaign hashtag “#TLC”.

A Wrightstown citizen voiced their concern on Facebook saying, “Isn’t it a policy violation to bring things to the schools promoting a campaign? Why did none of the admins at the school stop this??”

It is unclear if Lemke and Curtis’ offering to teacher’s violates Wisconsin State Law or Wrightstown School District Policy.

Other Wrightstown citizens have expressed outrage claiming that Lemke and Curtis may have violated Wisconsin election bribery laws.

According to Wisconsin Statute Chapter 12, election bribery involves offering, giving, or promising anything of value to influence and elector’s behavior. This includes:

  • Inducing an elector to go to or refrain from going to the polls.
  • Influencing an elector to vote or refrain from voting.
  • Paying money with the intent to bribe electors.

The same rules apply to recall petitions as they do to regular elections. Offering anything of value to influence the signing of a recall petition could be considered bribery and is subject to penalties.

To avoid violating election bribery statutes, individuals should:

  • Avoid giving gifts to those involved in the electoral process.
  • Express appreciation verbally or through social media without attaching physical gifts.
  • Separate campaign activities from appreciation gestures.

Maintaining the integrity of the electoral process is crucial. Understanding and complying with election bribery laws ensures fair and free elections and recall efforts in Wisconsin.
